App Terms of Use
These Terms & Conditions apply to all Jessica Vegas services and sales. Bridal Service Terms are included in your Bridal Beauty Package documentation and apply specifically to bridal bookings. They are not publicly displayed here but are available upon request.
These Terms of Use also govern access to and use of the digital services, portals, mobile apps, communications tools, and connected systems operated by Jessica Vegas Professional Hair & Makeup Artist ("Jessica Vegas", "we", "our", or "us"), including our website, client portal, bridal suite, team app, communications tools, and related integrations.
1. Acceptance of these terms
By accessing or using our website, apps, portals, bookings, communications features, or social-media-connected business tools, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the relevant service.
Where you accept a service proposal electronically — including by drawing or typing your signature and clicking an acceptance button on our online proposal page — that action constitutes a valid and binding electronic signature under the Electronic Transactions Act 1999 (Cth) and the Electronic Transactions Act 2000 (NSW). Your IP address, browser information, acceptance timestamp, and signature image are recorded at the time of signing as part of the legally binding record of your agreement.
No cooling-off period: Our service agreements do not include a cooling-off period. Once you have accepted a proposal or booking by any method — including electronic acceptance — the agreement is immediately binding and the cancellation terms in your service agreement apply. We recommend you read all Terms and Conditions carefully before accepting.
2. Scope of these terms
These terms apply to website visitors, Shopify customers, brides, booking contacts, client portal users, team members, artists, contractors, and anyone who interacts with our systems through email, SMS, Instagram, Facebook Messenger, forms, or social-media-connected features.
3. Eligibility and account access
You must provide accurate information when using our systems. You are responsible for keeping your login details, booking codes, links, and device access secure. You must not share protected access details with unauthorised people.
4. Acceptable use
You agree not to:
- Use our systems in a way that is unlawful, abusive, fraudulent, or misleading
- Attempt to access another person’s account, booking, portal, or private information
- Reverse engineer, scrape, interfere with, overload, or disrupt our systems
- Upload malicious files, harmful code, or unlawful content
- Use our apps or communications channels to harass, impersonate, spam, or violate another platform’s terms
5. Bookings, operational data, and communications
Our apps and portals may display booking information, schedules, invoices, files, support messages, runsheets, and related operational content. While we aim to keep this information accurate and current, you are responsible for notifying us promptly if you believe anything is incorrect.
6. Social media and messaging integrations
Our business systems may integrate with Instagram, Facebook, email, SMS, and other approved communications channels. If you contact us through those channels, you authorise us to receive, store, and respond to those messages as part of your customer or operational record.
Any use of our social-media-connected features must also comply with the applicable platform rules, including Meta policies and any content, messaging, or automation restrictions imposed by those platforms.
7. AI-assisted drafting and automation
Some communications, summaries, social captions, triage outputs, or suggested responses may be generated or assisted by approved automation or AI tools. These outputs are provided to support business operations and may require human review before being relied on or sent. We do not guarantee AI-generated content will be error-free, complete, or suitable for every context.
8. Mobile app and portal functionality
We may update, suspend, limit, or discontinue features in our client app, team app, bridal suite, CRM-connected portals, or social integrations at any time to maintain quality, security, compliance, or operational control.
9. Availability and uptime
We do not guarantee uninterrupted availability of our apps, portals, or integrations. Features may be affected by maintenance, third-party outages, platform restrictions, deployment changes, or circumstances outside our control.
10. Third-party platforms
Our services may rely on third-party platforms such as Shopify, Google, Meta, Stripe, Xero, Apple, OpenAI, Anthropic, and other approved tools. Your use of features connected to those services may also be subject to the terms and policies of those providers.
11. Payments, products, and service terms
Booking terms, product purchases, invoice obligations, cancellation rules, and service-specific requirements may also be governed by proposal terms, booking confirmations, product pages, invoices, or separate service policies. Where more specific terms apply to a particular booking, product, or service, those more specific terms control.
Booking Fee: Where a Booking Fee is required to confirm a service booking, that fee is non-refundable and is not a deposit. It covers proposal preparation, date reservation, artist scheduling, and ongoing administration from the date of booking. The Booking Fee is non-refundable except to the extent required by the Australian Consumer Law.
Late payment: Where an invoice remains unpaid after the due date, a late administration fee of $75 will be applied to your account immediately. In addition, interest accrues on overdue amounts at 10% per annum, calculated daily from the due date until paid in full. We also reserve the right to recover reasonable debt recovery costs and legal costs, to the extent permitted by law.
12. Intellectual property
Unless otherwise stated, our branding, app content, designs, workflows, copy, structure, and business systems are owned by Jessica Vegas or licensed for business use. You may not copy, resell, exploit, or distribute them without permission.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or business interruption losses arising from use of our apps, portals, social integrations, automations, or third-party platforms. Nothing in these terms excludes rights that cannot lawfully be excluded under applicable law.
14. Suspension and termination
We may suspend, restrict, or terminate access to any portal, account, or digital feature if we reasonably believe there is misuse, a security issue, unauthorised access, policy violation, legal risk, or operational need to do so.
15. Privacy
Your use of our services is also governed by our Privacy Policy. If there is a conflict between these Terms and a more specific privacy disclosure for a service or feature, the more specific disclosure will apply to that privacy issue.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia, unless another law applies and cannot lawfully be excluded.
17. Contact
If you have a question about these Terms, contact Jessica Vegas Professional Hair & Makeup Artist at hello@jessicavegas.com.

3. Preparation
3.1 Please arrive with: clean, freshly blow-dried hair (no wet, damp, dirty or product-laden hair); clean, moisturised skin with no foundation, self-tan, or heavy product applied.
3.2 Arriving unprepared may result in: insufficient time for a full service outcome; a preparation surcharge of $55 (inc GST); or a simplified or adjusted service.
4. Workspace, Safety & Hygiene
4.1 For mobile services, you must provide an indoor, well-lit, clean, ventilated workspace with access to power, a stable back-supported chair, and a stable work surface. Services will not be performed in bathrooms, wet areas, cramped spaces, or outdoor areas.
4.2 Outdoor services: Where outdoor coverage is requested, services may only be performed under substantial permanent covered structures (roofed patio, marquee). We will not perform services in direct sunlight, rain, or wind, or under portable or temporary umbrellas or shelters.
4.3 Stairs: Our artists can carry equipment up a maximum of two flights of straight stairs (maximum 24 steps). Spiral, narrow, or winding staircases are prohibited for kit transport. Where access requires more than two flights, you must arrange and pay a surcharge for handling assistance, or relocate the service area to a suitable floor.
4.4 All pets must be secured in a separate room or fully away from the service area. You are liable for any pet-caused damage or contamination to our kit, tools, or equipment.
4.5 Nothing in this clause limits our obligations under workplace health and safety laws or the Australian Consumer Law, or our liability for our own negligence or breach of law.
5. Health, Hygiene & Infectious Conditions
5.1 You must notify us in advance if you or any person receiving services has any allergies, sensitivities, recent cosmetic treatments, active skin conditions, or contraindications relevant to any product or service.
5.2 Do not attend your appointment if you have flu-like symptoms, are awaiting infectious disease test results, or have a contagious skin, scalp, or eye condition. Failure to notify us may result in refusal of service without refund.

5.4 For active cold sores or open lesions, you must supply and use your own sealed, unused products for the affected area.
6. Overtime
6.1 Overtime applies where the agreed session time is exceeded due to circumstances outside our control (including late arrival, unpreparedness, additional requests, unsuitable workspace, or third-party delays).
6.2 Overtime is charged at $15 per 15-minute block or part thereof, per artist, and is subject to artist availability.
7. Travel
7.1 Travel fees apply to mobile services beyond 20km from our studio and are quoted on a per-artist basis. Fees reflect distance, artist travel time, and the opportunity cost of artist availability during travel. Travel fees are confirmed in writing prior to booking. Parking must be provided at no cost to our artists at the service location.
8. Artistic Interpretation & Longevity
8.1 Inspiration images are a guide only. Exact replication of any reference image cannot be guaranteed due to differences in skin type, hair type, condition, available time, and individual characteristics.
8.2 We do not guarantee wear time or resistance to environmental factors (heat, humidity, perspiration, tears, skin oils, physical contact, or products applied before or after the service). Results after service completion are the client's responsibility.

9.1 Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.

2.6 Nothing in this clause affects your rights under the Australian Consumer Law.
